Nationwide Assembly Election Petition Tribunal sitting in Asaba, Delta Condition, has nullified the election of the member representing Aniocha/Oshimili Constituency at the Property of Representatives, Mr. Ngozi Okolie.
Okolie of the Labour Party (LP) was declared winner of the February 25 House of Reps election in the federal constituency by Unbiased National Electoral Fee (INEC).
But rapid previous Minority Chief of the House of Reps and prospect of the Peoples Democratic Get together (PDP), Ndidi Elumelu, submitted a petition ahead of the tribunal, praying it to disqualify Okolie.
Elumelu, in the petition (EPT/DL/HR/06/2023), argued that Okolie was not thoroughly sponsored by LP and that he did not resign his placement as a community business office holder.
The 3-member tribunal headed by Justice A.Z. Mussa, in its ruling, disqualified Okolie and declared the runner-up in the election, Elumelu, as winner.
The tribunal held that Okolie was not duly sponsored by LP and that he was not a member of the occasion as of Could 28, 2022, when the main was purportedly held. It also solved in favour of the petitioner that the second respondent (Okolie) did not resign from general public office to contest the election.
Speaking with newsmen following the ruling, counsel for the petitioner, Andrew Osemenem, mentioned: “The petitioner launched his petition on a single ground, and that is the floor of qualification. We reported by way of witnesses and paperwork that the LP applicant was not a member of the celebration as of May 28, 2022 when they purportedly held primaries for the National Assembly election.
“We also proved, and the tribunal agreed with us, that there have been no primaries, there was no sponsorship, and the Labour Social gathering did not perform any key into the Nationwide Assembly.”
